Earlier this week, a Lexington grand jury did not indict Lloyd Tubman on a rape charge, but that doesn’t necessarily mean he’ll be back on the UK football team anytime soon, and that decision may be out of Mark Stoops’ control.
According to the Herald Leader, under the UK student conduct rules, a case of sexual assault that goes to the police is automatically heard in an Office of Student Conduct hearing. Those hearings are held within 60 days of the incident and reportedly operate under a lower burden of proof than the criminal justice system.
In a series of Facebook messages, Tubman’s mother Warnetta Smith Cooper shared her thoughts on the situation. From the Herald-Leader:
“As it relates to UK, I don’t have any discussion to give other than how disappointed I am with the entire disciplinary board or whatever they may call themselves,” Tubman’s mother, Warnetta Smith Cooper, said in a series of Facebook messages.
“My son loves UK and wanted to be a part as a family of UK, but sincerely, they never proved me wrong of thoughts on how they treat their athletes.”
Cooper was careful to draw the distinction between the UK coaching staff, whom she called “decent and genuine,” and the disciplinary board, who she said “can never be trusted.”

Maybe I’ve missed something, but I’m not sure why his mother would throw stones if he wants to come back to play football at UK. I would think that keeping my mouth shut and walking a fine line would be the proper course of action…. Additionally, I’m not really sure why the university has to hold a meeting to rule on this. I would think that a GRAND JURY coming back with a decision not to indict would be enough for them to allow him to move forward. I understand that UK has a standard they want their students to live up to, but I would also think that a court decision would hold some merit in their decision. Time will tell I suppose.

ELEEM I AGREE WITH YOU 100 PERCENT, GRAND JURY DIDNT INDITE, SO THERE IS NOTHING THERE IMO. MOVE ON LET THE KID PLAY, ITS A NO BRAINER TO ME.

I am hoping to see the young man back on the team. I would rather see the Herald leader not interview family members. The media has no scruples. They should leave them alone, imho. It would be rather easy to get an inflammatory comment from a parent, if they get them worked up about their kid. Ask any little league coach or umpire how passionate the parents can be.

I think the media has always been intrusive, like interviewing people that lost a house in a fire or close family member to an accident or murder. Not good to mess with people in a time of crisis.

The reason that the University has to look into the situation is a law called Title IX. It is a very broad law that requires all colleges and universities to independently investigate all cases of harassment and abuse.
The legal system has very high standards for evidence and what constitutes a case that can be prosecuted. Title IX is very different -- a person can be cleared by the court system but still found to be in violation of Title IX.
I have no idea if Tubman would be found guilty of violating this statute, but Title IX is a big deal in colleges and universities today.

To even take a case to the grand jury there has to be some evidence to even make it worthy of taking to the grand jury. Perhaps not enough to indite but certainly enough to show wrong doing by the suspect(defendant)
I doubt if he will be back!
( I suspect his mother may have already got the word from UK)

If anyone has seen the video of the woman escorting the accused out of the building, it is difficult to fathom that the event was even close to an assault. I don't believe the accusation was brought up right away and if the woman was in distress, the video shows a different story.
As for the college ethics rules, I know nothing about them. But, if a person is cleared of charges, he shouldn't be punished.

I agree Boom - if Desmond Allen hadnt been kicked off the team (double jeopardy imv) by UK he might still be alive today!

I had to look up Desmond Allison. He was kicked of the team for being charged with DUI.....my internet search came up with a story that says he pleaded guilty to the charge. At the time, didn't the university have a zero tolerance policy for DUIs?
In my opinion, a DUI can be supported with scientific evidence, where in the instance of an alleged assault of a past girl friend, it is more of one person's word against the other and is not as cut and dry. I have seen people who were connected to crazy ex GFs and BFs. The measures that crazy people will go, just to cause trouble for the other is stuff that you just can't dream up. I don't know this situation, personally, but anything is possible.
I remember when Joker kicked his QB off the team and then he proceeded to lose the bowl game. The QB was taking his GF home and she got into an argument with another girl. Joker deserved to lose that bowl game and his record went downhill after that.

I'm just saying the zero tolerance by the University caused him to be dismissed. If they didnt have that then perhaps he would have stayed on the team and not got in the situation he got himself in later in life!
